By accessing or using our website www.monostate.co  , you agree to be bound by the following Terms and Conditions. 

Understanding our Terms & Conditions

When we refer to we, us, or our, we mean SOA STATE OF ALL HOLDING S.L.                         When we refer to you, your, or your, we mean you, the person using our services.

These Terms and Conditions may be updated or modified at any time, so we recommend that you review the website regularly to review and understand the legal terms that apply at that time.

Access to this site is granted only to individuals or entities who hold a valid credit or debit card issued by a bank approved by Monostate. 

All products available for sale are intended solely for personal use or as gifts. Items must not be resold, used for commercial gain, or otherwise exploited for business purposes. Monostate reserves the right to limit the quantity of any product shipped to a single customer or delivery address.

Registration 

To use some of the services or features made available to you on this website you will need to register for an account. When you register you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately at the following email address support@monostate.co  . We may also change registration requirements from time to time.

Scope

These Terms and Conditions apply to all purchases made through our website by consumers within the European Union active during the Beta phase.

Products

We strive to ensure all descriptions, images and prices are accurate. However, minor discrepancies may occur.

Payment

All prices include applicable VAT and are listed in EUR. Shipping costs, if applicable, are displayed at checkout. We accept the following payment methods: 

  • Credit card
  • PayPal.

Payment security

All transactions made on our website are processed through a secure payment gateway, which uses industry-standard encryption protocols to protect your card details.

If you are a registered user of Monostate, and you choose to save your payment details, they will be stored in encrypted form and used only for authorized purchases initiated by you.

We use Secure Socket Layer (SSL) technology to ensure a safe and reliable shopping experience.

Pricing 

From time to time, prices are subject to change in response to currency exchange rate changes and other commercial factors. The price applicable to your order will be the price current at the time your order is accepted.

If your credit or debit card is not issued in Euros, the final amount charged will be calculated using the exchange rate applied by your card issuer on the date the payment is processed.

Pricing errors

We make every effort to ensure that product pricing displayed on our website is accurate. However, from time to time, obvious pricing errors may occur. If such an error affects an item you have ordered we will notify you as soon as possible.

We are under no obligation to fulfil any order that contains an obvious pricing error.

We reserve the right to cancel such orders, even if they have been confirmed or are already being shipped. If you have already been charged, we will issue a full refund without delay. For items recalled during delivery, refunds will be processed once the products are returned to us.

Order process

An order becomes binding once you complete the checkout process and receive an order confirmation email from us. We reserve the right to cancel orders for any reason, including stock unavailability or suspected fraud.

Order acceptance & limitations

We reserve the right to decline your order under certain circumstances, such as:

  • if payment authorization cannot be obtained
  • if shipping restrictions apply to specific products
  • if the item is no longer in stock
  • if the item fails to meet our internal quality standards.

We also reserve the right to refuse service or transactions at our discretion, for any reason, including but not limited to:

  • breach of our commercial policy
  • suspicion of fraud or illegal activity
  • abuse of the platform or its services.

Should we need to cancel or reverse a transaction after processing has begun, we are not responsible for any resulting losses. We may also restrict orders placed by users who appear to be purchasing for professional or commercial use, rather than personal consumption.

Shipping and delivery

During the beta phase we ship to all countries within the European Union.

Delivery times

Estimated delivery times are provided at checkout. Delays may occur during peak seasons or due to customs or other external factors.

Returns

You have the right to withdraw from the contract within 14 days without giving any reason.

To exercise your right of withdrawal, you must inform us by email at support@monostate.co or through our contact form. You must return the product in its original condition within 14 days of notifying us.

Exceptions

Returns are not accepted for:

  • Used or damaged goods
  • Personalised or hygiene-sensitive items (underwear, swimwear,...) once unsealed

Refunds

Refunds will be issued within 14 days of receiving your returned goods, using the same payment method.

Warranty and liability

Consumers are entitled to a 2-year warranty under EU law. If the product is defective or not as described, please contact us for a replacement, repair or refund. We are not liable for indirect or consequential damages unless caused by gross negligence or misconduct.

Data protection & liability

We implement reasonable measures to keep your order and payment information secure. However, unless we are proven to have acted negligently, we cannot be held liable for any loss resulting from unauthorized access to your personal data by third parties.

Privacy and data protection

Intellectual property

All content on the website, including logos, images and product descriptions, is protected by copyright and intellectual property laws. Reproduction or distribution is prohibited without written permission. Including Monostate Software and all HTML and other code contained in this site. 

Monostate does not promise that the functional aspects of the website or Monostate's Content will be error free or that this website, Monostate Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.

No commercial use

This website is intended solely for your personal, non-commercial use. You are not permitted to alter, duplicate, distribute, transmit, display, perform, publish, license, exploit commercially, create derivative content from, transfer, extract data from, or sell any part of the content, software, products or services available on this site.

Use of this website or its content for any business-related purposes, including but not limited to advertising or generating ad revenue on your own site, is strictly prohibited.

If it is found that you have engaged in any prohibited behavior, failed to respect other users, or otherwise breached these Terms, we reserve the right to restrict or permanently revoke your access to the website.

Indemnification

At our request, you agree to fully indemnify, defend and hold us, along with our officers, directors, agents, affiliates, licensors, and suppliers, harmless without delay from any and all claims, liabilities, losses, damages, costs, and expenses (including legal fees) that may arise as a result of your breach of these Terms. This obligation also applies to any misuse of the website by others who gain access through your internet account due to your actions or failure to act.

No partnership

You understand and agree that no joint venture, partnership, employment, or agency relationship exists between you and us. You further agree not to present yourself as a representative, agent, or employee of Monostate under any circumstances. We disclaim all liability for any statements, actions, or omissions made by you in such a capacity.

Governing law and jurisdiction

These Terms are governed by the laws of Spain. Disputes arising from these Terms shall be resolved in the courts of Madrid, Spain, without affecting your mandatory consumer rights under EU law.
